Terms & Conditions

By accessing or using Gravity Movement Gym Koh Samui (hereinafter “Gravity Movement Gym,” “we,” “us,” or “our”)—operated by Destination Detox Co., Ltd (the “Company”)—you (the “User” or “Member”) agree to be bound by these Terms of Use. If you do not agree, please refrain from using our website or facilities.

1. Payments & Billing

Payment Methods: We accept credit cards, cash, bank transfers, QR code payments, and online payments via Opn Payments.

Pricing: We reserve the right to change our pricing.​

2. Membership & Bookings Policies

  • Types of Membership: We offer class passes, monthly memberships, and other options.

  • Cancellation:​

    • You may cancel a booking up to two (2) hours before class without losing the credit or fee.

    • You may reschedule a booking up to one (1) hour before class.

    • Late cancellations or no-shows may result in forfeiture of that session.

    • Memberships may be cancel anytime, but refunds will not 

  • Freezing & Cancellation:

    • Members can request to freeze their membership due to sickness, emergency, or travel (subject to approval and should be made as far in advance as possible).

    • Once a membership term has begun, no refunds are offered unless explicitly stated in the membership’s terms.

  • Pre-Booking:

    • Book your spot online or at reception at least (2) hours before class.

    • Walk-ins may be accepted if space allows.

  • Minimum Attendance:

    • Each class requires at least two (2) participants.

    • If fewer than two people sign up, the class will be canceled and the booked participants will be notified.

  • Class Pass Redemption:

    • Class fees or deductions from class passes are processed upon booking.

    • Even for memberships that include classes, you must reserve a spot in advance.

  • Gym Cancellations:

    • If the gym cancels a class (e.g., due to low attendance), we will determine whether participants receive a reschedule or credit, depending on their membership or pass type.

  • Late Arrivals:

    • Arriving more than 5 minutes late may result in losing your spot to a walk-in participant.

  • Waitlist:

    • If a class is fully booked, participants can join a waitlist. Open spots go to waitlisted users on a first-come, first-served basis.

  • Termination:

    • We reserve the right to terminate or suspend memberships without prior notice for:

      • Non-payment

      • Violation of these Terms or gym rules

      • Fraudulent or illegal activity

    • Refunds will not be given in the event of membership termination.

3. Assumption of Risk & Medical Disclaimer

  1. By agreeing to these Terms of Use, you acknowledge that you are responsible for your own health and safety.

  2. Medical Clearance: We recommend seeking professional medical approval before engaging in any physical activities, especially if you have existing health conditions.

  3. Liability:

    1. We are not liable for injuries, accidents, or other harms incurred while using our facilities or participating in our events.

    2. We do not guarantee any specific fitness results or outcomes.

4, Gym Rules & Conduct

  1. Footwear Policy:

    • No footwear on the MMA (grey) mats or in group class areas.

    • Shoes are optional in weight training/functional areas but required on treadmills.

  2. Equipment Use:

    • Members must re-rack weights and return equipment to its proper place.

    • Only active Members may use gym equipment. Visitors to reception/café or terrace areas must purchase food/beverages but do not have access to equipment.

  3. Intoxication: Intoxicated individuals will not be granted access.

  4. Prohibited Behavior:

    • Offensive or discriminatory conduct

    • Harassment or violence

  5. Enforcement: We reserve the right to suspend or ban Members for violating these Terms or engaging in prohibited behavior.

5. Intellectual Property

  • Ownership:

    • We own or license all copyrights, trademarks, and other intellectual property in our logos, photos, videos, and text (“Content”).

  • Media Usage:

    • Members and visitors are allowed to take photos and videos on the premises, provided they respect others’ privacy.

    • We may photograph or record Members for promotional or business use. By purchasing a membership and entering our premises, you consent to such recordings.

6. Disclaimers & Limitation of Liability

  1. Use at Own Risk: All activities are undertaken at your own risk.

  2. No Warranties: Our services and information are provided “as is,” without warranties of any kind.

  3. Downtime or Technical Issues: We are not responsible for website downtime or service interruptions.

  4. Limitation of Liability:

    • Our maximum liability for any claim is limited to the membership fees you’ve paid in the preceding 12 months.

    • We exclude indirect, punitive, or consequential damages to the fullest extent permitted by law.

7. Indemnification

  1. Member Responsibility: You agree to indemnify and hold us harmless from claims arising out of:

    • Your misuse of equipment or violation of these Terms

    • Your actions causing harm to others

  2. Limits:

    • Normal wear and tear of equipment is our responsibility.

    • Indemnification does not extend to employees acting within their scope, but does extend to independent contractors (operating under their own work permits).

8. Governing Law & Dispute Resolution

  1. Governing Law: These Terms are governed by the laws of the Kingdom of Thailand.

  2. Dispute Resolution:

    • We attempt to resolve disputes via mediation first.

    • If mediation fails, we proceed with arbitration.

    • If arbitration fails, the matter may be brought before the Thai courts.

9. Changes to Terms

  1. Right to Modify: We may modify these Terms at any time.

  2. Effective Date: Changes are effective immediately upon posting or notification.

  3. Continued Use: Using our website or facilities after changes means you accept the revised Terms.
